Before filling the form you have to agree with following conditions:
СОГЛАШЕНИЕ - ДОГОВОР
THE AGREEMENT - CONTRACT
The company " A.J.I. Entertainment ", in the further "Company", and the client filling the form, in the further, "Client" enter into the given Agreement - the Contract, in the further, "Contract" about the following:
1. THE SUBJECT OF THE CONTRACT
1.1. The company renders to the Client of service on search of work and employment abroad, and also, represents interests of the Client before potential Employers.
1.2. Компания может оказывать Клиенту консультационные юридические услуги.
1.2. The company can render to the Client consulting legal services.
1.3. Клиент знает и согласен с тем, что для повышения эффективности оказываемых услуг, Компания может опубликовать на своем сайте в сети Интернет те личные данные Клиента, его фотографии и видео материалы, которые посчитает нужными.
1.3. The client knows and agrees that for increase of efficiency of rendered services, the Company can publish on the site in the Internet those personal data of the Client, his photo and video materials as which will consider necessary.
2. PROCEDURE OF PAYMENTS AND TERMS OF PAYMENT
2.1. The Company renders to the Client of service on search of work and employment abroad is free-of-charge.
2.2. В случае оказания услуг указанных в пункте 1.2., Клиент осуществляет оплату Компании за эти услуги. Сумма оплаты в каждом конкретном случае оговаривается отдельно и описывается в Дополнении к Данному Договору.
2.2. In case of rendering services specified in iparagraph 1.2., the Client carries out payment of the Company for these services. The sum of payment of each concrete case stipulates separately and is described in Addition to the Given Contract.
3. FORCE-MAJEUR
3.1. None of the Parties shall be liable for partial or full non-fulfilment of its obligations if such non-fulfilment is a result of force majeure circumstances (earthquake, fire, flood, epidemic), as well as non-classical force majeure circumstances that may arise in the territory of Ukraine, namely: unforeseen political actions, ecocatastrophes, military operations, including battle (training) strikes, national and immigration agitation, decisions of governmental authorities, changes of the national legislation, arising after signing of the present Contract.
3.2. Если каждое из этих обстоятельств оказало непосредственное влияние на невыполнение обязательств согласно настоящему Договору, то срок выполнения обязательств переносится соответственно времени, на протяжении которого будут действовать эти обстоятельства и их следствия, препятствующие выполнению настоящего Договора.
3.2. If any of such circumstances has directly influenced a performance of obligations within the term specified in the Contract, term of liabilities fulfilment shall be extended to the period equal to that during which the circumstances and their consequences that preventing from the fulfilment of the present Contract, will remain in force.
3.3. Сторона, для которой создалась невозможность выполнения своих обязательств по выполнению настоящего Договора, обязана на протяжении двух недель с момента их начала или остановки, в письменной форме уведомить другую сторону. Факт, изложенный в сообщении, должен быть подтвержден Торгово-промышленной палатой или другими компетентными органами соответствующей стороны. Датой уведомления своего контрагента считать дату отправки указанного сообщения.
3.3. The Party which fails to perform its obligations under the Contract shall serve a written notice to the other Party about arising and termination of such circumstances within 10 days’ period from the moment of arising/termination of such circumstances. This fact, stated in a written notice should be confirmed by the Chamber of Commerce and Industry or other competent authorities of the corresponding party. Date of counteragent notification is considered to be a date of sending a written notice.
3.4. Не уведомление в срок оставляет как Компании, так и Работодателю право ссылаться на любое из вышеупомянутых обстоятельств, как на обстоятельство, которое освобождает от ответственности за невыполнение своих обязательств.
3.4. Failing to timely notify both the Company and the Client deprives them of their right to refer to any of the above circumstances as to a circumstance, that exempt from responsibility for non-fulfilment of their liabilities.
4. ARBITRATION
4.1. Company and Client take appropriate measures to peaceful settlement of all the questions and divergences, that may arise in connection with fulfilment of the present Contract.
4.2. Споры, которые возникают в ходе выполнения настоящего Договора или в связи с ним, подлежат рассмотрению в соответствии с действующим законодательством Украины.
4.2. Disputes, arising in the course of fulfilment of this Contract or in connection with it are to be passed for consideration in accordance with current legislation of Ukraine.
4.3. Правом, которое регулирует настоящий Договор, является материальное право Украины.
4.3. Material law of Ukraine is the right, regulating the present Contract.
5. OTHER CONDITIONS.
5.1. All Additional agreements to the present Contract should be issued in written form and are its integral part.
5.2. Данный Договор заключен сроком на 1 год и вступает в силу с момента его подписания сторонами. Если за месяц до окончания срока Договора любая из сторон не уведомит другую об окончании срока действия Договора, Данный договор автоматически продлевается на следующий год.
5.2. The given Contract is concluded for the period of 1 year and inures from the moment of its signing by the parties. If one month prior to the termination{ending} of term of the Contract any of the parties{sides} will not notify another on the termination{ending} of validity of the Contract, the Given contract is automatically prolonged for next year.
5.3. Настоящий Договор составлен в двух экземплярах, оба экземпляра имеют равную юридическую силу и находятся у каждой из Сторон.
5.3. The present Contract is made in duplicate, both of a copy have an equal validity and are at each of the Parties.
